1.1 The promoter is between Ormco B.V., whose registered office is at Amsterdamseweg 51B, 3812RP, Amersfoort, Netherlands and with VAT number NL802703847B01 (the “Company”). 

1.2 By entering this promotion, all participants will be deemed to have accepted these terms and conditions in full. All entry instructions form part of these terms and conditions. To enter the promotion, you must have completed aligner or orthodontic treatment and either currently wear retainers or plan to wear them. 

1.3 The promotion is open to residents of Great Britain aged 18 or over at the date on which they enter the promotion, excluding: 

1. employees of the Company its group companies, its agents or anyone professionally connected with this promotion and any member of their respective immediate families; and
2. any individual who is a dental healthcare provider including, but not limited to, dentists, hygienists, orthodontists, endodontists, periodontists, prosthodontists and oral surgeons.

1.4 Entry opens at 9am GMT on 20 February 2025 and closes at 5pm GMT on 27 February 2025 (the “Promotional Period”). Entries received after the Promotional Period will not be eligible to win a prize. 

1.5 No purchase is necessary to enter the promotion. However, in order to enter the promotion you must have an Internet connection and an active Instagram or TikTok account.

2.1 To enter the promotion, you must follow the steps below: 

1. Follow @sparkaligners_uk on Instagram or @sparkaligners_europe on TikTok.
2. Like the official giveaway post (that is pinned at the top of the relevant social media page) and comment “I want #sparkretainers” on the official giveaway post on either Instagram or TikTok and you must include in your comment whether you’re already wearing retainers or planning to soon.

2.2 Only one entry is permitted per person per platform during the Promotional Period. The Company may run multiple promotions, contests, or other competitions simultaneously. Entry into any of those other promotions, contests or competitions, whether managed by the Company or its business partners does not constitute an entry into this promotion and each promotion, contest or competition shall have its own terms and conditions participants must adhere to. 

2.3 You should only enter the promotion if you have already completed aligner or orthodontic treatment with any provider and either already wear or plan to wear retainers. This is a condition of being awarded a prize and the Company may seek further verification or information from you to satisfy this condition if you are selected as a winner.

3.1 Following the end of the Promotional Period, three (3) winners will be selected at random from all eligible entries received using the Simpliers Giveaway Tool. The chance of winning depends on the number of eligible entries received during the Promotional Period. 

3.2 Only the winners will be notified by direct message on the platform used for entry (Instagram or TikTok) on 10 March 2025 (the “Selection Date”). If the winners are deemed to have satisfied the terms and conditions of the promotion and are eligible to win a prize, then each winner will be asked to provide their postal code to match them with a Spark provider nearby (Company do not guarantee that there will be a provider near to your residence). You will not be contacted if you are not successful. 

3.3 In line with the UK Code of Non-broadcast Advertising, Sales Promotion and Direct Marketing (CAP Code), in respect of any winners the Company will either publish or make available information that indicates that a valid award took place on the Company’s website: sparkaligners.com. For example, the surname and county of residence of the winners. The Company will also require that the winners participate in any reasonable publicity required by the Company. The winners may have the right to object to all or part of this information being published or made available – in such event they should inform the Company in writing. In such circumstances, entrants acknowledge that the Company must nevertheless still provide the information and winning entry to the Advertising Standards Authority (ASA) on request. 4.1 There is a total of three (3) prizes available to be won. Each winner will be awarded one set of custom-made Spark retainers that will be tailored to your needs by a dental professional offering Spark services. Each prize includes: (i) one scan with the Spark service provider to create the custom-made retainers, (ii) a Spark retainer box, (iii) a Spark retainer case, (iv) a Spark set of retainers. The prize does not include any follow up or additional appointments, aftercare or further treatments with the Spark provider, any replacement or additional retainers or associated products, nor any additional taxes or fees payable. 

4.2 Each Spark provider may have separate terms and conditions that you may be required to enter into to fully redeem the prize. Any questions, concerns or issues you have with the treatment and/or the prize should be directed to the specific Spark provider that provided your treatment.

5.1 In the event that (i) the Company is unable to contact a winner or does not receive a response within 8 days of the Selection date, or (ii) any winner rejects the prize, and/or (iii) any information submitted by the winner is determined to be false or not compliant with these terms and conditions, the Company reserves the right to award the prize to an alternative winner selected in accordance with these terms and conditions. 

5.2 The winner will be required to provide their postcode to the Company to confirm their nearest Spark provider. Winners will then be required to attend the Spark provider to obtain a scan. As the retainers are custom-made, this step is mandatory. Once the scan has been completed, winners will receive their 

5.3 No cash alternative. Prizes are non-transferable and cannot be resold. The Company reserves the right to substitute an alternative prize of equal or greater value. Unless otherwise agreed in writing by the Company, the prize will only be awarded to the winner. 

5.4 Each winner agrees to take part in reasonable publicity as may be required by the Company in respect of the promotion. You may be asked to provide your permission for Company or its agents to photograph, film, and record each winners and to use such winner’s photograph, voice, biographical information, and/or any statements made by each winner regarding the promotion for purposes of trade, publicity, or promotion without notice or additional compensation. By posting or publishing the promotion entries containing any text, videos, graphics, photographs, trademarks, logos, sounds, or any other audio or visual material whatsoever (“Materials”), you agree that you have all necessary rights to distribute such Materials contained therein. You hereby grant to Sponsor and our authorized personnel a worldwide, royalty-free, fully-paid, exclusive, transferable, sub-licensable (as necessary in connection with the promotion) license to copy, publicly perform, publicly display, publish, distribute, create derivative works of, and use Materials as we deem appropriate. You acknowledge and agree that Company will own all right, title, and interest in and to any Materials, content, or other works of authorship created by Sponsor or on its behalf and used in connection with the promotion. 

5.5 No entries from agents, third parties, syndicated entries or those made using methods such as a computer macro, script or the use of automated devices are permitted and no bulk entries. 

5.6 All costs and expenses not included within the prizes are the responsibility of the winner(s). 

5.7 The Company reserves the right at any time, in its absolute discretion, to: 

1. verify the eligibility of any participant (including their age, place of residence and that they have previously had orthodontic or aligner treatment in compliance with these terms and conditions);
2. disqualify any participant found to be abusing or tampering with the operation of the promotion or entering using fraudulent means, or who the Company believes to have acted in breach of these terms and conditions;
3. disqualify participants who do not give correct contact details or those who make an entry on someone else's behalf; and
4. disqualify any participant posting an entry or a comment to the Company’s Instagram or TikTok that is, in the Company’s opinion, inappropriate, offensive or upsetting to other participants, fans of the Company or contrary to applicable law, and to remove any such entry or comment.

6.1 The promotion is not in any way sponsored, endorsed or administered by, or associated with Instagram or TikTok. Participants acknowledge that Instagram or TikTok shall not have any liability to them in connection with the promotion.

6.2 Subject to paragraph 6.3, if the Company fails to comply with these terms and conditions, it will be responsible for loss or damage participants suffer that is a foreseeable result of the Company’s breach of these terms and conditions. The Company is not responsible for any loss or damage that is not foreseeable. 

6.3 The Company shall not be liable for: (i) any failure to comply with these terms and conditions as a consequence of events beyond its reasonable control including without limitation, any failure of communication networks and any closure of Spark providers premises or interruption in supplies as a consequence of any circumstances beyond the reasonable control of the Company; (ii) any breach of the Spark provider’s terms and conditions it has entered into with you, and/or (iii) any loss of profits, loss of revenue or other economic loss or any indirect or consequential loss. 

6.4 Except as otherwise required by applicable law, the Company accepts no responsibility or liability for any entry or claim which for technical or other reasons is unsuccessful, incomplete, lost, late, damaged, corrupted or misdirected.

7.2 The Company reserves the right to extend, withdraw, alter or suspend the promotion or to amend these terms and conditions at any time if circumstances beyond its control make this unavoidable. 

7.3 All personal data submitted in connection with the promotion will be processed by the Company for the purposes of administering and managing the promotion and the award of prizes (where applicable) and verifying the eligibility of a participant. Data that is collected from or about participants will be used in accordance with the Company’s Privacy Policy, a copy of which can be found at here. 

7.4 Any images are an illustrative example and do not show the exact prize(s). 

7.5 The promotion and these terms and conditions, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with English law and participants can bring legal proceedings in respect of the promotion and these terms and conditions in the English courts. Participants living in Scotland will also benefit from any mandatory provisions of Scottish law and can bring legal proceedings in respect of the promotion and these terms and conditions in either the Scottish or the English courts.
